Who will be included in the RETA (Special Diet of Trabajdores Autónomos)?

Workpeople older than 18 years, which, of habitual, personal and direct form, realize an economic activity to lucrative title, without subjection for contract of employment.

Spouse and relatives up to the second grade inclusive (in case of workpeople of the Special System of Self-employed persons, up to the third grade) for consanguinity, affinity and adoption that collaborate with the self-employed person of personal form, habitual and direct and do not have the wage earners condition.

The economically dependent self-employed persons to whom II of the Law recounts the Chapter III of the Title 20/2007, of July 11.

The foreign self-employed persons who reside and exercise legally his activity in Spanish territory.

Professionals who exercise an activity for proper account, which needs the incorporation to a Professional School which group has integrated into the Special Diet of Self-employed persons.

Those who exercise functions of direction and management that bears the performance of the charge of adviser or manager, or give other services for a capitalist mercantile society, to lucrative title and of habitual, personal and direct form, whenever they possess the effective, direct or indirect control, of that one. It will be understood, in any case that produces such a circumstance to himself, when the actions or shares of the worker suppose, at least, half of the share capital.
It will be presumed, except test in opposite, that the worker possesses the effective control of the society when some of the following circumstances meet:
- That, at least half of the capital of the society for whom it gives his services is distributed between associates, with whom it coexists, and whom one finds joined by conjugal tie or of kinship by consanguinity, affinity or adoption, up to the second grade.
- That his participation in the share capital is equal or superior to the third part of the same one.
- That his participation in the share capital is equal or superior to the fourth part of the same one, if it has attributed functions of direction and management of the society.
The hard-working associates of the labor societies, when his participation in the share capital together with that of his spouse and relatives for consanguinity, affinity or adoption up to the second grade, with that they coexist, reaches, at least fifty for hundred, unless he credits that the exercise of the effective control of the society needs the contest of persons foreign to the familiar relations.

The Lines ICO have been approved 2009 of Support to the Company: Entrepreneurs, SME, Managerial Growth and Internationalization, which are framed inside the Plan for the Stimulus of the Economy and the Employment.
The Line ICO-PYME increases his budgetary endowment up to 10.000 million euros and every businessman will be able to dedicate up to 40 % of the credit obtained to complementary financing to the investment in fixed assets that it carries out.
There is created a new line for 10.000 million euros to finance circulating.
A moratorium of one year is granted to the companies that are paying a credit of the line ICO-Pyme.
